FAQ

Frequently asked questions

What is the difference between debt discharge and bankruptcy?
Debt discharge (personal bankruptcy) is available to natural persons — it allows the debtor to repay a portion of their debts, with the remainder written off, provided they follow a repayment schedule or liquidate assets over 3–5 years. Bankruptcy (konkurs) is a liquidation procedure: all of the debtor's assets are monetised and the proceeds distributed among creditors. Bankruptcy applies primarily to legal entities or where the debtor does not qualify for discharge.
What does "special insolvency administrator licence" mean?
Czech insolvency law divides administrators into two categories: general and special-licence. A special-licence administrator is authorised to administer the estates of banks, insurance companies, savings cooperatives, and other financial institutions — entities whose insolvency has wider economic consequences. The licence is granted only after rigorous vetting by the Czech Ministry of Justice. JUDr. Jiřina Lužová has held the special licence since 2009.
How does claim registration work?
If your debtor has entered insolvency, you must register your claim in the proceedings within the deadline set by the court — typically two months from commencement. Registration is filed electronically via the insolvency register (ISIR). A correctly prepared and timely submission is a prerequisite for participating in the distribution of proceeds. Missing the deadline forfeits the claim. We are happy to assist you with the registration.
How much does legal representation cost?
The fee depends on the scope and complexity of the matter. We offer both hourly rates and fixed fees for straightforward cases. The first consultation is always non-binding and free of charge.
How long does debt discharge take?
The standard length of discharge proceedings is five years. If the debtor repays at least 60% of registered claims within three years, the court may grant early discharge. Once all conditions are fulfilled, the court writes off the remaining debts. The total duration depends on the debtor's income, the extent of their assets, and whether they meet every payment obligation on time. We are happy to give you a more precise estimate for your specific situation.
Can I keep working or running my business during proceedings?
Yes. Employees may continue working without restriction — the portion of their salary above the statutory protected minimum is remitted to the insolvency administrator. Self-employed individuals may also continue trading, but must report income regularly and comply with all obligations imposed by the court. In both cases, taking on new liabilities without the administrator's consent is prohibited, and the debtor is required to maximise income for the benefit of creditors. If you are considering a change of employment or expanding your business, we recommend consulting us first.
